Civil litigation and dispute resolution, contract and obligations law, employment law, corporate law and M&A for mid-sized businesses.

An assessment of the facts, the legal basis, the evidentiary position and the financial interest, before the first letter goes out.

Why

In law since
2006
Practice
A.N.A. Buyserd LL.M., jurist
Based in
Berlicum, the Netherlands
Languages
Dutch and English

A business owner pursuing a claim is entitled to know what that claim is worth before committing money and time to it.

That assessment precedes every letter and every set of proceedings. It is candid about what the facts will support, and about what they will not, including when the conclusion is that a case should not be brought.

Clients

Owners of mid-sized businesses in the Netherlands.

The practice is built around the owner-director and the entrepreneur who has a dispute, or can see one coming, and who wants to know where they stand before starting.

Owner-directors

Position within the company, liability, and disputes with fellow shareholders.

Family businesses

Relations between generations, shareholder arrangements and succession.

Manufacturing

Terms of supply, non-conformity, warranties and product liability.

Wholesale and import

Distribution and agency relationships, debt recovery and international sale of goods.

IT and software

Development and licence agreements, service levels and termination.

Professional services

Engagement terms, liability and disputes with clients.

Real estate and letting

Lease relationships, sale agreements and disputes over defects.

Retail and e-commerce

Standard terms, consumer rules and supplier disputes.

Healthcare practices

Partnership and collaboration arrangements, admission and withdrawal.

Early-stage companies

Incorporation, shareholders' agreements and first contracts.

Practice areas

Five areas in which the practice works.

01

Civil litigation and dispute resolution

Substantive proceedings, interim relief, attachment and enforcement. Buyserd Juridisch Advies is not a firm of attorneys and works together with established law firms in proceedings where representation by an attorney is mandatory.

02

Contract and obligations law

Drafting, reviewing and unwinding agreements. Performance, termination, damages and liability.

03

Employment law

Dismissal, settlement agreements, non-competition and non-solicitation clauses, terms of employment and liability within the employment relationship.

04

Corporate law

Shareholder relationships and disputes, directors' liability, articles of association and intra-company agreements.

05

M&A for mid-sized businesses

Share and business acquisitions and disposals, from letter of intent to completion, including warranties and indemnities.

How it works

Establish what a case is worth. Only then choose.

01

Assessment

Every matter begins with an assessment of the facts, the legal basis, the evidentiary position and the financial interest, resulting in a view on the prospects, including the weaknesses.

02

Choice

On that basis you decide: settle, litigate or let it rest. The decision is yours; the reasoning is mine.

03

Execution

Correspondence, negotiation and proceedings, with a single point of contact and no intermediate layers. You deal with the person handling the matter.

The practice

Civil litigation and dispute resolution

Fees

The starting point is an hourly rate, exclusive of VAT, agreed in writing in advance.

By way of exception, a matter may lend itself to a success-based fee or a no cure no pay arrangement.

A limited number of matters are handled pro bono, without charging for legal assistance.

Every matter starts with an assessment at a fixed price agreed in advance; what follows is agreed only after that.
